2 Collection and storage of personal data as well as type and purpose and their use

We collect the following data:

  • form of address, full name of contacts
  • company name
  • email address
  • postal address
  • phone number (land line and/or mobile phone)
  • bank details
  • contract master data
  • readings and test data

We collect your data for the purpose of:

  • implementing the contractual relationship and/or performing our contractual and precontractual obligations
  • statutory and regulatory requirements
  • general correspondence
  • internal administration and statistics
  • event management

The data collection and processing is necessary

  • for implementing the contract and our precontractual obligations and
  • for complying with legal obligations as well as
  • on the basis of legitimate interests of ROSTOCK PORT GmbH

and is based on Art. 6(1) GDPR. As far as we have obtained your consent for processing operations of personal data the legal basis is Art. 6 (1) letter a) GDPR. 

3 Transfer of data to third parties

Your personal data will not be passed on to third parties other than for the purposes listed hereinafter. As far as it is necessary as per Art. 6(1) s. 1 letter b GDPR for the implementation of the contractual relationship with you, your personal data will be passed on to third parties. Recipients of the data are (1) subcontractors of the controller who have been entrusted with the implementation of the contractual relationship, (2) public bodies that receive data on the basis of statutory provisions (e.g. social insurance agencies, fiscal authorities), internal agencies involved in the implementation of the respective business transactions (in particular bookkeeping, banking institutions/payment service providers, accounting) as far as required and/or allowed by statutory provisions.

Sources of data

As far as we did not collect your personal data directly from you, these data come either from public sources (in particular Internet searches and address books, yello pages) or from participant lists of events (for example conference participant lists, trade fair catalogs).

User rights

You have the right:

  • under Art. 7(3) GDPR to withdraw your consent granted to us, at any time. This results in us not being allowed to continue in the future the data processing which was based on this consent;
  • under Art. 15 GDPR to demand information about your personal data processed by us. In particular you may demand information about the purposes of processing, the category of personal data, the category of recipients to whom your data were or are being disclosed, the planned storage duration, the existence of a right to rectification, erasure, restriction of processing or appeal, the existence of a right to lodge a complaint, the origin of your data as far as they were not collected by us as well as the existence of an automated decision-making including profiling and, if applicable, meaningful information on their details;
  • under Art. 16 GDPR to demand the rectification of incorrect personal data or the completion of your personal data stored by us, without undue delay;
  • under Art. 17 GDPR to demand to erasure of your personal data stored by us as far as the processing is not necessary for exercising the right to freedom of expression and the right to information, for performing a legal obligation, for reasons of public interest or for asserting, exercising or defending legal claims;
  • under Art. 18 GDPR to demand the restriction of processing of your personal data as far as the correctness of the data is contested by you, the processing is unlawful but you reject the erasure of the data and we no longer need the data while you need them to assert, exercise or defend legal claims or you have filed an objection against the processing under Art. 21 GDPR;
  • under Art. 20 GDPR to receive your personal data which you have provided to us in a structured, commonly used and machine-readable format or to demand their transmission to another controller and
  • under Art. 77 GDPR to lodge a complaint with a supervisory authority. Usually you may for this purpose turn to the supervisory authority of your habitual residence or place of work or the authority at the seat of our company.

6 Routine erasure and blocking of personal data

We process and store your personal data only for the period that is necessary for achieving the purpose of storage or as far as stipulated by the European issuer of directives/European regulator or by another legislator in laws or regulations which govern the controller responsible for the processing.

If the storage purpose lapses or if a storage time limit stipulated by the European issuer of directives/European regulator or by another competent legislator expires the personal data will be routinely blocked or deleted according to the statutory provisions.

7 Right to file an objection and to withdraw consent, demand for erasure and rectification

You may withdraw your consent to the processing of your personal data and to have your personal data erased and/or changed at any time. If the data are necessary for the implementation of the contract or for the implementation of pre-contractual activities a premature erasure of the data is only possible as far as it does not contradict contractual or statutory obligations.

Requests for information, rectification and erasure as well as the withdrawal of consent and/or an objection with regard to the further use of the data subject to any consents granted us may be made/stated without formality by letter, email or telefax to ROSTOCK PORT GmbH.
